FORESTRY DEPARTMENT PENINSULAR MALAYSIA -CONSTITUTIONAL PROVISIONS





• Article 74 (2) of the Federal Constitution provides that land and forest are matters under the jurisdiction of the respective state governments. Each state is independently empowered to enact or formulate laws and regulations on forestry. The federal government, on the other hand, extends technical assistance, training, research and development.

• The National Forestry Council (NFC) was established on 20 December 1971 by the National Land Council (NLC) to discuss and resolve common problems and issues pertaining to policies, administration and management of forests.

NATIONAL FORESTRY POLICY (NFP)
• The NFP was formulated and accepted by the NFC in 1977. It was later revised in 1992 to address issues raised by local and global communities on the need to conserve biodiversity, use of sustainable genetic resources, and the role of local communities in forestry development.

Purpose of Revising the NFA 1984
• To provide for heavier penalties and more stringent
controls;
• To facilitate the substantiation of forest offences in
the courts;
• To delegate power under certain sections to the
armed forces to enforce the NFA 1984;
• To allocate provisions of incentive in the form of rewards and protection to informers for information on offences and seizures committed under the act;
and to update the NFA 1984 to suit current requirements and rectify any minor errors.
