Sabah High Court declared Kurup’s seat vacant


Deputy Rural Development Minister, Tan Sri Joseph Kurup lost his Pensiangan parliamentary seat when Kota Kinabalu High Court declared it vacant.

He is no longer a deputy minister following the decision to declare null and void his election as the unopposed winner of the Pensiangan parliamentary seat.

Kurup, who is Parti Persatu Rakyat Sabah (PBRS) president, won the seat unopposed on nomination day for the 12th general election after the returning officer rejected the nomination papers of Danny Anthony Andipai of Parti Keadilan Rakyat.

In his ruling, Justice Wong held that Returning Officer Bubudan OT Majalu had no right to overturn the state Election Commission deputy director’s decision to accept Danny Anthony Andipai’s nomination papers on Feb 24.

He also ruled that the objections against Danny Anthony Andipai’s nomination papers were invalid as wrong objection forms were used, the objector’s signature was missing, there were several authors to the objection forms and there were no written records as to when Bubudan received the objections.

Kurup, said he would appeal against the decision. He has two weeks to do so, failing which a by-election would have to be called. He instructed his lawyer to immediately file for a stay of execution on High Court judge Justice David Wong Dak Wah’s decision yesterday to allow the petition of PKR candidate Danny Anthony Andipai.
